What is the California Lemon Law?

California Lemon Law (officially titled the Song-Beverly Consumer Warranty Act; California Civil Code §§ 1790 et seq.) was enacted to protect all consumers who purchase or lease a vehicle with a warranty. California’s Lemon Law not only applies to cars and trucks, but to all warrantied consumer goods including motorcycles, RVs, motorhomes, boats, other watercraft, and all other consumer items. California Lemon Law covers new and used vehicles, both purchased and leased.

Does my vehicle qualify as a lemon?

All that’s required to qualify for protection under California’s Lemon Law is that the vehicle you purchased was sold with any kind of warranty (even a simple 30 day/1,000 mile warranty), and that any problems that started within that warranty period were not repaired within a reasonable number of attempts.

The most common misconception about California’s lemon law is that it only applies to vehicles that are less than 18 months old, or have been driven less than 18,000 miles. In fact, lemon law applies to any improperly repaired vehicle that was sold with a warranty, regardless of the vehicle’s age or mileage.

Even if a vehicle’s warranty has expired, your vehicle still qualifies so long as the defect first occurred while the vehicle was under a warranty.
