What is the California Lemon Law?

California Lemon Law (officially called the Song-Beverly Consumer Warranty Act; California Civil Code §§ 1790 et seq.) was established to protect any consumer purchasing or leasing a vehicle with a warranty. The lemon law requires that a vehicle’s warrantor repurchase or replace the vehicle if it can’t be fixed after a reasonable number of attempts and is then determined to be a “lemon.”

If you choose to have your vehicle repurchased, the warrantor is required to pay back your down payment, monthly payments, and pay off any remaining balance of your loan or lease. Regardless of whether you ultimately choose a repurchase or a replacement, you’re entitled to recover all the taxes and licensing costs you’ve paid, as well as any other expenses like towing costs, rental car costs, and related repair fees.

The Lemon Laws of California not only apply to personal vehicles, but to all warrantied consumer goods including motorcycles, RVs, motorhomes, boats, other watercraft, and all other consumer items. California Lemon Law covers new and used vehicles, both purchased and leased.

Does my vehicle qualify as a lemon?

To qualify for California lemon law protection, all that’s required is that the vehicle you purchased or leased had any kind of warranty (even a simple 30 day/1,000 mile warranty), and that any defects that started during that warranty period were not fixed within a reasonable number of attempts.

Unfortunately, a very common misconception regarding the lemon laws in California is that they only apply to vehicles less than 18 months old, or that have been driven less than 18,000 miles. However, the lemon law applies to any improperly repaired vehicle that was sold or leased with a warranty, regardless of the vehicle’s age or mileage.

Even if your vehicle’s warranty has since expired, it could still qualify for lemon law protections so long as the defect occurred while the vehicle was under its warranty. A quick call to one of our experienced Lemon Law attorneys can help you determine if your vehicle is a “lemon” and what legal options are available to you.

If the problems with your vehicle began during the first 18 months and/or 18,000 miles of your vehicle’s warranty (known as the “presumption” period), then you qualify for additional lemon law coverage. These additional protections presume that your vehicle is a lemon. Normally you, the consumer, would have to prove your vehicle is a lemon to win a case, but when your vehicle meets the presumption requirements, it becomes the warrantor’s (often the manufacturer’s) burden to prove that your vehicle is not a lemon. Think of it as the warrantor is presumed guilty until proven innocent.

California’s lemon law provision of "presumption" is neither a requirement nor a prerequisite to file a lemon law claim in Burbank. There are numerous situations that don’t meet the "presumption" provision of California’s lemon law, but still qualify your vehicle as a lemon.

Does my boat/watercraft qualify as a lemon?

As long as your boat or watercraft was covered under warranty and its defects were unable to be fixed after a reasonable number of attempts, then it’s protected by the lemon law.

The California lemon laws that protect consumers do not just extend to personal vehicles like cars or trucks. If your boat or other watercraft vehicle didn’t perform as it should according its given warranty, then you may qualify for a refund, replacement of your vehicle, and related damages. Even if your warranty has now expired, if your boat’s initial problems occurred during the active warranty period, then it’s highly likely that you have a case.

Can I afford a Lawyer for my Burbank Lemon Law claim?

Absolutely! The California Lemon Law requires that the warrantor (manufacturer/dealer/service contract provider) pay for your legal fees if you win your case. How long does a Lemon Law case take?

The usual lemon law case takes between thirty to forty-five days to settle, with ninety-eight percent of civil cases settling prior to going to trial. While each case is unique, and each manufacturer and dealer handles cases differently, we make every effort to settle your case as quickly and efficiently as possible without having to file a lawsuit. Our reputation and success record have made us are very successful at accomplishing this goal.

Unfortunately, some manufacturers and dealers don’t always decide to resolve their lemon law claims, or they try to make offers lower than what the law entitles you to. In the uncommon event that it is necessary to file a lawsuit, it could take longer to settle your case; but rest assured, we’ll pursue your claim efficiently and to the fullest extent of the law in order to get you the highest settlement possible.
